Terms and Conditions
By accessing, browsing, using, registering or contributing to the Breathe-zy website and any other area of our website where you can post submissions or reviews or ask questions you confirm that you have read, understood and agree to the following terms. If you do not agree to these terms in their entirety, you must not use this website.

Ownership of Submissions
Other than personal data which is subject to our Privacy Policy all comments, blogs, feedback, suggestions, questions, ideas, artwork, images, product or marketing ideas and any other submissions disclosed, submitted or offered to Breathe-zy on or through the website or otherwise disclosed, submitted or offered by you (collectively, “Submissions”) shall become and remain the property of Breathe-zy once submitted. You must comply with the content standards set out in these terms. You warrant that you own or have the right to use any Submissions and that your Submissions will comply with these standards and guidelines.

Social networking sites
These terms also govern any Submissions you make on any Breathe-zy related third party website or page such as our Facebook page, Twitter, YouTube or social networking site. All comments, images, videos and any other type of material posted on any third party social networking site do not necessarily reflect the opinions or ideas of Breathe-zy or its employees and Breathe-zy is not responsible for any such content. In any event, all material posted on any third party social networking site must comply with these terms and the third party social networking sites’ Terms of Use, as applicable.

Intellectual Property Rights
A disclosure, submission or offer of any Submissions and your agreement to these terms and conditions shall constitute an assignment to Breathe-zy of any intellectual property rights. Whenever you make use of a feature that allows you to upload material to our site, including questions, or to make contact with other users of our site or to make Submissions on any Breathe-zy related third party website or page, you must comply with the content standards set out below and these terms. Any third-party advertising on Breathe-zy pages of third party social networking sites are not the responsibility of, or endorsed by, Breathe-zy. All rights, including copyright on Breathe-zy pages are owned by or licensed to Breathe-zy. Any use of any Breathe-zy social networking pages or their contents, including copying or storing them in whole or in part, other than for your own personal, non-commercial use is prohibited without the permission of Breathe-zy.

Confidentiality
Any material you upload to our website will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute any material in the Submissions for any purpose. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our site or any Breathe-zy related third party social networking site constitutes a violation of their intellectual property rights, or of their right to privacy. We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of our website. We have the right to remove any Submissions you make on our website if, in our opinion, such Submission does not comply with the content standards set out below.

Breathe-zy, in its absolute discretion, reserves the right to:
not publish the Submission or remove it
take any appropriate legal action if deemed necessary

Terms and Conditions relating to the supply of goods listed on our website
This page (together with the documents referred to on it ) sets out the terms and conditions on which we supply the goods listed on our website. These terms and conditions apply to all transactions between Breathe-zy and you. They do not affect your statutory rights. Please read them carefully.
These terms and conditions are governed by English law and are subject to the non-exclusive jurisdiction of the English courts.

Customer Sales
We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

To order goods over the phone or on our website you must be at least 18 years of age.

All telephone orders will be acknowledged verbally at the time of the order, and all orders placed on our website will be acknowledged by e-mail. Please note that verbal and / or electronic acknowledgments do not constitute order confirmation or order acceptance. Your order will be accepted and the creation of a legally binding contract between you and us will take place once the goods have been paid for. We may decline all your order for any reason in which case we will inform you in-person or by telephone or e-mail.

We will tell you if your payment details cannot be authorised for any reason and may invite you to pay by another method or suggest you revisit Breathe-zy. Please note images featured and displayed on our website may differ in colour hue, intensity and detail to your web browser or computer, tablet, mobile phone or television screen. This may be attributed to your devices settings including non-laboratory colour calibrated screen settings.

The total cost of your order will be the price of the products inclusive of delivery to an address in England, Ireland, Wales and Scotland.

The total amount payable will be stipulated at the time you place your order, whether or not the order has been acknowledged.

We are entitled to make adjustments to the price to take account of any increase in our Suppliers prices, additional charges for carriage or the imposition of any taxes or duties. Or if due to an error or omission the price published for the goods are wrong, whether the order has been acknowledged. We will inform you of the correct price and give you the opportunity to cancel the order. All prices are inclusive of VAT, and inclusive of delivery charges.
Prices may be liable to change and /or availability before (but not after) we accept your order. If a product is not available we may offer you an alternative or suggest you visit Breathe-zy.

All product information, descriptions or other information communicated by us is intended to be as accurate as possible, from information supplied by manufacturers.

We accept major credit cards and debits cards including Visa, MasterCard, Maestro and Delta. This is the address and telephone number which your credit card or debit card / bank has on file for you. Your order will only be processed once authorisation of your credit/ debit card has been properly received.

All goods and services are subject to availability and may be withdrawn at any time. If we do not supply the goods for any reason we will not charge you for them and will refund any money you have paid for them. We will not however be responsible for compensating you for any other losses you may suffer if we do not supply the goods.

Delivery
All our prices are inclusive of delivery charges. A charge is not made for the delivery of the goods. however, in the event of additional charges we will strive to keep cost as low as possible but will give you the option to either pay the due amount or cancel your order. Generally where an order contains more than one item we deliver all items together.

We will only deliver to the cardholders registered address. You will be contacted by telephone or e-mail to confirm your delivery date. Once we have agreed a delivery date you must be present on this day to take delivery. Delivery to a non-residential or third party address is solely at our discretion.

Delivery times are calculated in working dates i.e. Monday to Friday but exclude bank holidays.

On occasion goods are subject to availability and delay in delivery is sometimes outside our control. As such delivery cannot be guaranteed and any dates we specify for the delivery of goods are only approximate. We will not be liable for any losses, costs, damages or expenses caused by any delay for delivery of the goods.

If we or our suppliers are temporarily out of stock we will notify you as soon as possible. If you are unable to accept delivery on the day we have agreed please notify us as soon as possible and at least 24 hours ahead of the planned delivery. If you do not notify us within this time and we are unable to deliver the goods to your home on the day agreed we reserve the right to charge a second delivery fee.

All items must be unpacked and inspected on delivery and a signature obtained. A signature checked or unchecked deems the products to be in good condition and the delivery completed satisfactorily and no claim can be entered into following delivery. This does not affect your statutory right. Should any issue arise with either the delivery service or the products please contact us whilst delivery drivers are on site.

Cancellations and Returns
You have the right to cancel your order at any time up to 14 working days starting the day after delivery for credit or refund. Items must be in an unused condition and returned in the original packaging.

Please note you have a duty of care while the goods are in your possession and as such we advise customers to return the product with the original packaging to insure the product is not damaged on its return journey. Return delivery is to be paid solely by the Customer, not Breathe-zy.

You must notify us of your intention to return the goods by e-mail within 7 working days of delivery.

The returned products must be returned in the exact same condition as when bought.  All items will be inspected upon arriving back at Breathe-zy.  Exchanges / Refunds will only be completed if Breathe-zy are satisfied with the condition of the returned products.

Refunds
Full refunds of the cost of the goods is wholly conditional on the above conditions being met and will be within 30 days of cancellation.

Bespoke items are not returnable, unless they develop a fault that falls under the responsibility if the manufacturer.

The returned products must be returned in the exact same condition as when bought.  All items will be inspected upon arriving back at Carousel.  Exchanges / Refunds will only be completed if Breathe-zy are satisfied with the condition of the returned products.

Guarantees and Warranties
All goods supplied are covered by the terms and conditions of the manufactures guarantee for a maximum of twelve months. If your product is under a year old and has a fault that is not through your own over-use, mis-use, accidents or neglect then please return it back to us along with a proof of purchase, (receipt/bank statement) where we would then take the appropriate course of action. We will repair it free of charge or replace at our discretion.The guarantee does not include any claims for consequential losses nor does it affect your statutory rights.
If the goods are being used in a non domestic environment they will not be covered by manufacturers warranties.

Please note that due to Health and Safety Regulations we are not obliged to undertake any repairs to items returned to us in a ‘soiled’ condition. We reserve the right to return such items without action, or (in the event of a refund) subtract the cost of said item.

VAT Exemption
Any products that qualify for VAT Exemption will only be dispatched once we have received a completed VAT Declaration Form.  The VAT Declaration Forms can be downloaded on each qualifying product page. Completed forms must be emailed to fiona@carouselcare.com.  Once this has been received, the order will be fulfilled.

Faults
If the fault developed within 28 days of delivery you will be offered the choice of exchange or refund.

Data Protection
We follow strict security measures; we do not pass on, or sell any information to third parties. We may from time to time contact you by e-mail with any current offers or promotions that we think may be of interest to you.

We primarily hold data to validate delivery details and manufactures warranties.
